North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: vehicular traffic: a)jobsite (corner of Franklin St & Ray Ave) - where exposed employees were working within and in near proximity to the roadway without the use of cones and work zone signs to inform vehicular traffic of their presence. Abatement Note: One feasible and acceptable abatement method, among others, to correct this hazard is to install high visibility cones and traffic signs to worn vehicle traffic in the work area. {Reference: Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) 2000 Millennium Edition of MUTCD, revision 1 December 28, 2001}.er
