Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: Location - Truck Yard: On or about 12/12/07, an employee was subjected to hand injuries by adjusting scrap metal on the truck hydraulic liftgate while it was being raised. Among other methods, feasible means of abatement methods include: (1) Instruct employees to not allow any part of their body to be placed under, within, or around any portion of the moving liftgate or its mechanisms, or in a position that would trap them between the platform and the floor of truck body (or between the platform and the ground) when the liftgate is operating. (2) Follow liftgate manufacturer recommendations regarding proper use. (3) Replace warning decals and operating manuals as needed.
