Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees riding on the side of equipment were exposed to falling off, being ran over, striking obstacles and/or being struck by passing vehicles or other equipment: a)Traveling north on Lucky Avenue between James Avenue & Adams Street - Chubbuck, ID; On or about 9/16/08 and at times prior thereto, the employer did not prevent an employee from riding on the steps of a rubber tire loader/backhoe while it traveled down the street. Note 1: Abatement certification is NOT required for this item. Note 2: One feasible means of abating this condition is by following the manufacturer's operation manual (Cat, Page 21, SMCS Code 7000) where it provides the warning to never permit riders unless an additional seat/seatbelt is provided and/or the Equipment Manufacturer's Institute's manual for 'Backhoe/Loader' where it provides the warning to never permit riders.
