Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and struck-by hazards from rail cars: (a)On or about 11/03/2007 - Employees engaged in unsafe work practices, such as standing on rail cars while they were in the processes of coupling, mounting and dismounting moving cars, and crossing between the ends of moving cars in the same train. Among other methods, feasible and useful methods may include, but may not be limited to, (1) not permitting employees to mount, dismount, or stand on rail cars that are in the process of being coupled, (2) not permitting employees to mount or dismount rail cars while the rail cars are in motion, (3) not permitting employees to cross between moving cars, (4) developing a program that establishes written operating procedures for handling rail cars by switch crews that includes, statements of safe work practices, procedures when encountering unsafe work conditions and reporting those unsafe conditions, an inspection program to measure performance with adhering to those work practices, and an orientation program to include all plant personnel responsible for briefing of the hazards associated with rail car movement at the site.
