North Carolina General Statute 95-129(l) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to methylene bisphenyl isocyanate (MDI) levels that were above the American Conference of Governmental Industrial Hygienists (ACGIH) eight hour threshold limit value (TLV) of 0.005 parts per million MDI per million parts of air (ppm): a)spraying area, employees were exposed to 0.0375 ppm MDI when applying the Rhino Lining bedliner over sixty minutes of sampling, zero increments were assumed for the remainder of the eight hour workshift. Note: A feasible means of abatement would be to increase the ventilation in the area and implement a filter changeout schedule.
