Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazards of amputations. (a)Facility - On or about August 25, 2009 the McClain/Epco baler was being operated with the front top loading chamber door open. The safety switch/interlock that was installed by the manufacturer was not functional. Among other methods, one feasible and acceptable abatement method to correct the hazard includes but not limited to: (1) Comply with the American National Standards Institute, ANSI Z245.5 - 1997, Baling Equipment Safety Requirements, Section 7.1(h): Specifically inspecting safety interlock, switches, and other protective devices, to ensure that these devices are not disabled or bypassed, and not permit the baler to be operated unless the devices are fully functional.
