Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to the absence of markings on "Below-the-Hook" Lifting Devices". At the worksite, employees were exposed to struck-by hazards due to no markings were visible on the Below-the-Hook Lifting Devices or inspection plate. All structural and mechanical lifting devices shall be marked with, but not limited to, the following: - Manufacturer's name and address - Serial number of the device - Lifter weight if over 100 lb (45 kg) - cold current (amps) (when applicable) - Rated voltage (if applicable) - Rated load [as described in para. 20-1.2.1(a)] - ASME BTH-1 Design Category - ASME BTH-1 Service Class Reference ASME B30.20-2006, Chapter 20-1 Structure and Mechanical Lifting Devices states; Section 20-1.2.1., Marking - Identification, as to; (a)On or about August 5, 2009, the #1 block crane (b)On or about August 6, the #1 bench crane (c)On or about August 12, the #3 bench line crane Among others, one feasible and useful abatement method to correct these hazards is to; Affix an identification plate to the device which includes the information required by ASME B30.20- 2006 above.
