Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a fall hazard of 18 feet when climbing the guardrails of JLG scissor lifts for access to the roof. (a)MS Embroidery Building - On or about March 13, 2008 employees were observed climbing on the guardrails of the two JLG scissor lifts for getting access to the roof. The employees were exposed to an 18 foot fall hazard. Among other methods, a reasonable and feasible method to eliminate the hazard would be to train or instruct employees on prohibited practices contained in the JLG Operators and Safety Manual and the Manual of Responsibilities for Dealers, Owners, Users, Operators, Lessors and Lessees of ANSI/SIA A92.6-1990, Self-Propelled Elevating Work Platforms, paragraph 7.11.1, "Personnel shall maintain a firm footing on the platform floor while working thereon."
