Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by front-end loader. (a)Plant Site - On or about March 10, 2008, employees were exposed to a struck by hazard from a John Deere front-end loader(544H) being driven in the reverse. The back up alarm was not operational to warn employees the front-end loader was traveling in reverse direction. Among other methods, one feasible and acceptable method to abate this hazard is to: Perform a diagnostic test prior to use to ensure the back up alarm is operational.
