Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards as three pieces of equipment used to move landfill materials did not have operable horns and/or reverse signal alarms: (a)On or about December 17, 2007 at the worksite Caterpillar D6H Dozer and 826C Compactor moving and covering the waste materials did not have operable horns, exposing the employees on the ground to struck-by hazards. (b)On or about December 17, 2007 at the worksite Caterpillar D6H Dozer, 826C Compactor and Bell B25 dump truck moving and covering the waste materials did not have operable reverse signal alarms, exposing the employees on the ground to struck-by hazards. Among others, one feasible and useful abatement method to correct these hazards is to: (1) Repair and maintain the manufactured installed horns. (2) Install and/or repair the reverse signal alarms. ANSI Standard Z245.1-2007 Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment Safety Requirements, Paragraph 7.2.13.2 requires operable horns and reverse signal alarms be provided on all vehicles.
