Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazard. (a)Franklin Lumber Company - On or about November 12, 2007 an employee was working from a home made metal bucket being lifted by a 966 Caterpillar, the employee fell out and was struck and killed by the bucket. Among other methods, one feasible and acceptable abatement methods to correct this hazard included but not limited to: 1. Use an approved lift such as a bucket lift with fall protection or a scissor lift when servicing the sorter. 2. Install a cat walk with guardrails in the area for employees to use when servicing the sorter.
