Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls while being elevated on the forks of a industrial truck without the means of fall protection: a)Warehouse area of supermarket: An employee was elevated approximately 118 inches above the ground on the forks of a Caterpillar Hyrdo Electric industrial truck (5DB2500), to enable them to reach a pallet of coffee, without any means of fall protection, on or about 12/6/07. Among other methods, feasible and acceptable methods to correct this hazard includes, but is not limited to the following: 1) Provide an additional portable ladder for use. 2) Implement a policy instructing employees to use the industrial truck to lower the needed pallet to ground level in order to retrieve products safely. 3) Provide a work platform for the industrial truck following the protection outlined in the ASME Standard B56.1-2000 paragraph 4.17.3 which includes that the platform complies with the design requirements in paragraph 7.36.3. 4) Implement precautions for suing an industrial truck to elevate personnel as outlined in ASME Standard B56.1-2000 paragraph 4.17.2. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
