Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed from falling off or being ejected from a powered industrial truck: City Dock 29; fork truck operators engaged in shore side cargo handling activities are exposed to crushing hazards from falling off or being ejected from fork trucks where the operators are not wearing seat belts. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to implement and enforce both the manufacturer's procedures for seat belt use and their fork truck operating rules requiring employees to use the operator restraint system while operating the fork truck.
