North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Job site- where an employee was working on a telescopic boom, Genie S-60, 30 feet from the ground. The employee was not being attached to the anchorage point provided in the platform by the manufacturer. The employee was tied off to a metal wire rope that was attached to the platform using u-clamps and quick link connectors (the load ratings for the metal wire rope, u-clamps and quick link connectors were unknown). Among other methods, one feasible and acceptable abatement method to correct this hazard is to have operators attached their harnesses to the anchorage point provided by the manufacturer when operating the telescopic boom, Genie S-60.
