Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicular traffic: Location: IFO 233 Benedict Ave. On or about 10/24/08 a) Employees were unloading landscaping equipment from a trailer that was attached to a work vehicle. The employees were not adequately protected from vehicular traffic. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19. Among other methods, a feasible and acceptable abatement method to correct this hazard is to follow the Manual on Uniform Traffic Control Devices for Streets and Highways 2003 Edition which describes how to set up workzones and to train employees in safe workzone practices.
