Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling loads and/or falling hoist parts: a)Shop Area: A CM Valustar underhung hoist was being used to lift metal tubes and metal angles. The hoist components, including, but not limited to, operating mechanisms, limit devices, braking systems, hooks, etc. had not been subject to regular inspections; on or about 7/16/08. b)Shop Area: A underhung hoist was being used to lift oven control cabinets and the hoist components had not been subject to regular inspections; on or about 7/16/08. One feasible and acceptable abatement method, among others, to correct this hazard is to conduct the frequent and periodic inspection requirements referenced in ANSI/ASME B30.16- 2003. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.ce
