Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of an explosion or fire due to the ignition of a combustible dust by static discharge: Location: Production area a) Non-conducting flexible plastic hose used to connect the sifter to the metal transfer pipe creates a potential for static build up during the transfer of flour. If a combustible concentration of dust is present during the transfer, static discharge could result in an explosion and/or fire, exposing employees to the hazards of serious thermal burns and/or being struck by debris in the event of an explosion. Abatement Methods One of the feasible means of abatement to correct this hazard would be to follow the requirements of NFPA 61, "Standard for the Prevention of Fires and Dust Explosion in Agricultural and Food Products Facilities,"2008 Edition. Section 11.2.1 and 11.2.2 of this standard states: " All systems components shall be electrically conductive. Bonding and grounding shall be provided for all components including sight glasses and couplings. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
