North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard as a result of tipover while operating a Powered Industrial Truck for failure to use the operator restraint devices or seat belts: a)warehouse area- employee(s) were observed operating forklifts without the use of seat belts. ABATEMENT NOTE: Among other methods,one feasible method to reduce this hazard is to follow the requirements of ANSI B56.1, Consensus Standard for Powered Industrial Trucks,in addition require employees to use the restraint devices or seat belts.
