North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by or crushed by falling from the bucket of backhoe while riding the bucket out of the trench: a)jobsite, one employee was observed riding the bucket of the backhoe out of the trench after positioning of one of two concrete manhole pipes (5' dia and 5' high); the trench was 14 feet deep Among other methods, one feasible and acceptable abatement method to correct this hazard is to position a ladder for the employee to stand on during this type of work and to prohibit the riding of the backhoe buckets.
