North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to bing struck by or crushed by the powered industrial truck in the event of an upset: a)establishment - employees operate a Clark forklift to move rolls of paper in the warehouse and to load and unload trucks at the loading dock. The forklift was not equipped with a seatbelt which could result in an employee being thrown from the lift truck in case of a vehicular accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a retrofit seatbelt available from the manufacturer and require employees to use the seatbelt when operating the lift.
