29 CFR 1910.119(h)(3)(ii): The contract employer did not assure that each employee was instructed in the applicable provisions of the emergency action plan: a. On or about February 24, 2009 and at times prior Energy & Environmental Measurement Corp. did not ensure that employees were protected from explosion/fire/chemical exposure hazards. The employees were not properly instructed concerning provisions of CFR 1910.38 Emergency Action Plans. 1. CFR 1910.38(c)(2): Calls for types of evacuations and exit route assignments. The employees were not given clear instructions on types of evacuations and specific techniques (wind direction and strength) to be used in making a safe escape. They were also not given a clear exit route when moved around the plant 2. CFR 1910.38(d): Calls for a distinctive signal for each purpose. The employees did not know how many signals or what each distinctive alarm meant.
