Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 12 feet: (a) Location- 601 Donald Lynch Blvd- behind the Coach Store: On or about September 12, 2007, an employee was standing with one foot on the top of a 12 foot fiberglass ladder and the other foot on a pipe. Among other methods, a feasible means of abatement methods includes: The use of ladder with sufficient height, where the employee does not need to stand on the top rung or the next highest rung to reach the work surface.
