Text For Citation: 01 Item/Group: 001 Hazard: GUARDING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard: a) Production Area - Where point of operation guarding was not feasible, the employer did not develop and implement a minimum safe distance program for the protection of employees who operated press brakes including, but not limited to 123 ton Darley press brake (model EHP 110 31/25, sn #12800) and the 60 ton Darley press brake (model EHP 50 25/20, sn #122143). On or about 7/10/07. One feasible and acceptable abatement method is to develop and implement a minimum safe distance program that conforms to the requirements of ANSI B11.3-1982, Paragraph 6.1.4.3 and OSHA Directive CPL 2-1.25. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
