Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee was exposed to a fall hazard: a)Worksite, 19 Peacock Drive, East Hills, NY - Employee was riding in the bucket of a Case 590 Super M, Series 2 Loader Backhoe to unhook the clips from the ring and clean dirt off the top of the ring prior to having the next ring installed; on or about 12/8/09. Among other methods, two feasible and acceptable means of abatement would be: 1)Follow the manufacturer's guidelines set forth in the operating procedures manual Page 14 that states "Do not permit riders on the machine" and page 27 which states "No Riders". 2)Train employees to not ride in the bucket per the manufacturer's guidelines. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
