Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a "Contact Trip" Pneumatic Nailer: a) Worksite, 102 Hildreth Avenue, Southampton - One employee who was bending over constructing a wood stud wall, stood up and made contact with the actuation trip tip of the nailer that was held by the employee working above on a ladder; on or about 03/19/09. The injured employee was not wearing any head protection. ABATEMENT NOTE: Among other methods, one feasible and acceptable method is to follow the Bostitch Coil-Fed Pneumatic Nailer Manual; Page 3 Safety Instructions: Some environments will require the use of head protection equipment. Operation; 2.) Never pull the trigger unless nose is directed towards the work. The Operator must not hold the trigger pulled on contact arm tools except during fastening operation as serious injury could result if the trip accidently contacted someone or something and caused the tool to cycle. Keep hands and body away from the discharge area of the tool. Page 6 To Prevent Accidental Injuries: Never place a hand or any other part of the body in nail discharge area of the tool while the air supply is connected. Never point the tool at anyone else. Never pull the trigger unless nose is directed at the work. Page 7 Operation 1.Contact Trip Operation: The operator must not hold the trigger pulled on contact trip tools except during fastening operation, as serious injury could result if the trip accidently contacted someone or something causing the tool to cycle. Page 8 Tool Operation Check 2. Sequential Trip Operation: In addition to the other warnings contained in this manual observe the following for safe operation Never use this tool in a manor that could cause a fastener to be directed toward the user or others in the work area. Always be aware that misuse and improper handling of this tool can cause injury to yourself and others. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
