Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from other vehicles and a struck-by and fall hazard from the refuse collection vehicle: a)Chatam Lane, Port Richey - On or about 5/25/07,employees were exposed to the hazard of falling from or being struck by a refuse collection vehicle, license plate number N9181L, and the hazard of being struck by vehicular traffic, in that: the employees were allowed to ride on the rear riding step of the waste collection vehicle as it was operated in reverse; the vehicle's back-up alarm was not operational; the employer installed a riding step that extends beyond the rearmost structural portion of the vehicle; the employer failed to ensure that employees exposed to vehicular traffic wear high visibility apparel when collecting refuse; and, the employer failed to affix retroreflective sheeting on the vehicle. One feasible means of abatement would be to comply with the American National Standards Institute, ANSI Z245.1-1999 and 2007, American National Standard for Mobile Wastes and Recyclable Materials Collection, Transforation, and Compaction Equipment Safety Requirements and the manufacturer's instructions on riding steps and employer responsibilities. Ensure that employees who operate any vehicle equipped with riding steps ensure that no persons ride on the steps when operating in reverse (reference paragraphs 6.1.4.1 and 6.2.5.4.b of ANSI Z254.1-2007). Ensure that the vehicle has an operational back-up alarm (reference paragraph 7.2.13.2 of ANSI Z254.1-2007). Ensure that riding steps are located behind the rearmost axle of the vehicle, but don't extend beyond the rearmost structural portion of the vehicle (reference paragraphs 4.3 and 7.2.9.f of ANSI Z254.1-1999). Ensure that employees exposed to vehicular traffic wear high visibility apparel when collecting refuse (reference paragraph 6.1.7.8 of ANSI Z254.1-2007). Affix retroreflective sheeting on the vehicle (reference paragraph 7.4.1 of ANSI Z254.1-2007)
