Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from other vehicles and a struck-by and fall hazard from the waste collection vehicle: a)At the jobsite, employees were exposed to the hazard of falling from or being struck by a Dempster RouteKing II waste collection vehicle and being struck by vehicular traffic, in that: the employees were allowed to ride on the rear steps of the waste collection vehicle as it was operated in reverse; the additional rear riding step was manufactured out of flattened expanded sheet metal giving it a smooth, flat, slippery surface; the employees were allowed to ride on the rear steps of the waste collection vehicle when it traveled in excess of 0.2 miles, both traveling forward and in reverse; and, the employer had attached an additional rear riding step on the vehicle that extended beyond the rearmost structural portion of the vehicle. On or about 5/3/07. One means of feasible abatement would be to comply with the American National Standards Institute, ANSI Z245.1-1999 and 2007, American National Standard for Mobile Wastes and Recyclable Materials Collection, Transforation, and Compaction Equipment Safety Requirements and the manufacturer's instructions on riding steps and employer responsibilities. Ensure that employees who operate any vehicle equipped with riding steps ensure that no persons ride on the steps when operating in reverse, or ride on the steps when the distance traveled exceeds 0.2 mi (0.3km). Ensure that the riding steps on the vehicle have a self-cleaning slip-resistant surface. Ensure that riding steps are located behind the rearmost axle of the vehicle, but don't extend beyond the rearmost structural portion of the vehicle.
