Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the spreader bar: At the job site, on or about August 8, 2007, and at times prior thereto, thereto, the employer violated this standard, when a SkyTrak 6036, rough terrain forklift truck was fitted with a steel beam attachment used as a spreader bar in the process of setting down rebar mats. The truck had not been marked to identify the attachment and to show the approximate weight of the truck, fork and attachment combination, and the capacity of the forklift truck with the attachment at maximum elevation with the load laterally centered, exposing employees to the hazards of being struck by the spreader bar and/or the load. Among other methods, one feasible and acceptable method of abatement would be to ensure that when modifications or alterations to a rough terrain forklift truck, which may affect the capacity, stability or safe operations of the truck, the truck will be marked with the identity of the attachment, the approximate weight, and the capacity of the truck with all attachments, as required by ASME B56.6- 2002, Section 5.2.3.
