Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by: Among other methods, one feasible and acceptable method to correct this hazard is keep employees on one side of the road in front of the litter crew vehicle. a.On or about April 9, 2007, Interstate 20/59 between mile makers 65 and 66, employer did not prevent employees from crossing the interstate exposing employees to being struck-by on-coming vehicle traffic during litter pickup.
