North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught-in-between hazards: a)throughout the facility, forklift trucks were installed with an overhead guard, but seat belts were not worn by forklift operators, exposing those employees to a struck-by hazards in the event of the forklift overturning. b)throughout the facility, two forklift trucks that were installed with overhead guards were missing seat belts, exposing those employees to a struck-by hazards in the event of the forklift overturning. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to wear seat belts when operating forklift trucks. Reference: American Society of Mechanical Engineers, Safety Standard for low lift and high lift trucks, ASME B56- 1-1993, paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.
