P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The operator was exposed to being thrown, ejected and crushed. a)On or about March 13, 2009, an employee was observed not wearing his seatbelt while operating a GENIE Telescopic Load-All forklift, Model GTH-644 GENIE, S/N N48170, as a result the operator was exposed to being thrown, ejected and crushed. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Is to require and enforce the use of a seatbelt, per the requirement of the operator's manual. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
