P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a platform which was raised 9 feet above the ground with a rough terrain forklift: a) East Side of Building - An employee was exposed to a fall hazard while working on an unapproved elevated platform that was supported by the Telescopic Load-All Make 506C, Model Load-all JCB, S/N 1184701. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the JCB operator's manual page 65, which states that under no circumstances should personnel be lifted into the air without using an approved and properly secured platform.
