Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Hazards - 5(a)(1) - Falling/Crushing: Employees were operating forklift trucks without wearing the seat belt, exposing the employees to the hazard of falling and being crushed by the powered industrial truck. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to: 1. Enforce the safety policy of wearing seat belts at all times, while operating the powered industrial truck and retrain employees on the importance of wearing
