Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the freight elevator landings were not guarded when the elevator was not at each floor creating fall and struck by hazards to employees. (a)First floor production area and second floor storage area - On or about 8/15/07, employees at the freight elevator landings at each level were exposed to fall hazards of between 4 and 10 feet on the first and second floor landings and struck-by hazards on the first floor landing. The door at the second floor could be opened when the elevator was not at the landing. The first floor landing had no door. Among other methods, one feasible and acceptable abatement method to correct the hazard is: To place metal gates over each entrance that would prohibit the elevator from operating unless the gates were closed. The gate on the first floor landing would also be at a height that would prevent an employee from placing their head in the elevator shaft while the elevator was overhead.
