Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)In the production area outside of kiln # 13, employees were required to load hardwood inside of a large kiln. Employees load this kiln while a 2,000 pound steel door leans against the kiln. There were 30 mile per hour winds in the area on the day of the accident. The wind gust blew the door over on top of the employee. The employer was aware that kiln doors are placed in an upright position on the side of the kiln in the work area when not in use, and employees are constantly exposed to struck by and crushed by hazards. Among other feasible and acceptable methods to correct this hazard would be to; install hinges on all twenty-one (21) of the kilns located in the work area. Another feasible means of abatement would be to place all kiln doors flat on the ground when not in use. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
