Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: Loc: 22 W 19th St, New York, N.Y. On or about 04/18/07. a)Employees were out on the 11th floor ledge without fall protection during window cleaning operations. Employees went out onto the ledge to clean windows which could not pivot inward due to being obstructed by file cabinets; and were not protected from falling. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Comply with Industry Standard; International Window Cleaning Association (IWCA) I-14.1- 2001 Window Cleaning Safety: Part 3.8 "Fall Protection", which states; "Fall protection, perimeter guarding, personal fall arrest systems or a personal fall restraint system (as applicable) shall be provided for all work areas..." Part 3.4 "Training", which instructs the employer to train employees in "safe and proper working procedures and practices". NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
