North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards: a)facility, employees were required to walk through and work in the yard where facility lighting was insufficient (0 to .1 footcandles). On or about March 20, 2007, an employee was struck by a Mack Truck. b)facility, employees were required to walk through and work in the yard where trucks drive with their lights off. On or about March 20, 2007, and employee was struck by a Mack Truck. ABATEMENT NOTE: Among other methods, feasible and acceptable methods to abate the hazard are to install adequate facility lighting and drive with vehicle lights on.
