North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from a fall to a lower level: a)jobsite scissor lift, for the employees who climbed out of the Genie Scissor lift by climbing over the lift's guard rail system, no fall protection was used, exposing employees to a 12 foot fall hazard to the grass below. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements of section 8.10 of ANSI A92.6-1999, specifically, paragraph (9) Personnel Footing. "Personnel shall maintain secure footing on the platform floor while working thereon".
