Text For Citation: 01 Item/Group: 001 Hazard: LIFTING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, the Hyster forklift was not equipped with a seat belt. The forklift was used for job tasks such as but not limited to moving racks, lifting metal parts and loading/unloading trucks. This condition existed on or about May 8, 2007 and times thereto and exposed employees to the hazard of being struck-by the forklift in the event of a tip-over accident. Feasible and acceptable abatement methods to correct this hazard include the installation of a seat belt and the institution of a seat belt program that requires and enforces the use of the seat belt.
