Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about April 3, 2007, and at times prior thereto, pipe racks loaded on top of four tiers of drilling pipe on a 32 foot flatbed truck trailer were not loaded in a safe and stable manner and exposed employees to the hazards of being struck by the pipe racks in the following instances: (a)one of the two triangular pipe racks was loaded on the truck in an inverted position (b)the pipe racks were placed higher than the pipe bunks which were used to restrain the load (c)the chain used to secure the two pipe racks together was removed prior to unloading the racks OR IN THE ALTERNATIVE 29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked and limited in height so that it was stable and secure against sliding and collapse: On or about April 3, 2007, and at times prior thereto, pipe racks loaded on top of four tiers of drilling pipe on a 32 foot flatbed truck trailer were not loaded in a safe and stable manner and exposed employees to the hazards of being struck by the pipe racks in the following instances: (a)one of the two triangular pipe racks was loaded on the truck in an inverted position (b)the pipe racks were placed higher than the pipe bunks which were used to restrain the load (c)the chain used to secure the two pipe racks together was removed prior to unloading the racks Among other methods, feasible and acceptable abatement methods to correct the hazard would be to: (1) load pipe racks onto truck beds only in the upright position, (2) ensure that the pipe bunks are high enough to restrain the load and (3) leave racks chained together until the racks are unloaded from the truck.ed
