North Carolina General Duty Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Facility, Battery Charging Area - Plumbed emergency eyewash and shower was not located on the same level as the hazard. REF:ANSI Z358.1-1998, Chapter 9, Paragraph 9.4.1 Combination units shall be in accessible locations that require no more than 10 seconds to reach. The combination unit shall be located on the same level as the hazard and the path of travel shall be free of obstructions that may inhibit the immediate use of the equipment. NOTE: Among other methods, one feasible acceptable abatement method to correct this hazard is to relocate the emergency eyewash and shower per the requirements of section 9.4.1 of ANSI Z358.1-1998.
