Text For Citation: 01 Item/Group: 001 Hazard: CHEMICAL
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while addressing a chemical spill in the roadway. On May 8, 2007, employer did not ensure that the employees who were working in the roadway to contain and clean-up a spill of Guardsman Max and 28Nitrogen mix were protected from vehicular traffic. Employees performing the clean-up operations were exposed to struck-by hazards from on-coming traffic. Among other methods, one feasible and acceptable method to correct this hazard would be to follow Chapter 6, Temporary Traffic Control, outlined in the Manual on Uniform Traffic Control Devices, 2003 edition, consisting of but not limited to, an appropriate traffic control plan, appropriate traffic control zone, and appropriate worker safety considerations.
