Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Battery Charging Area, on or about 02/13/2007: A Coffing 2-ton overhead hoist used to lift and lower fork truck batteries did not have the lower limit switch adjusted to regulate the load travel: Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: Ensure that the upper and lower safety limit switches are functional and properly adjusted to ensure the load is properly regulated. b)Battery Charging Area, on or about 02/13/2007, A Coffing 2-ton overhead hoist used to lift and lower fork truck batteries had not been inspected and no records or external coded marks were in use to identify periodic inspection evaluations: Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: Conduct frequent and periodic inspections of all hoists by a designated person, who makes records of external conditions to provide the basis for a continuing evaluation. An external coded mark is acceptable in lieu of records, in accordance with ANSI B30.16-1993, Section 16-2.1: Inspection, Overhead Hoists (Underhung). Abatement certification must be submitted for these items.
