North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)falling off of the LULL Highlander Forklift-employees were observed standing on the forks of the LULL Highlander Forklift conducting mason work on the roof while the lift was in a raised position at a fall height of approximately 12'8". One feasible and acceptable abatement method(s) to correct this hazard include the employer not allowing employees to ride on the forks of a forklift truck.
