Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard and to the hazard of being injured by a moving elevator: Location: 44 Troutman St, Brooklyn, N.Y. On or about 01/30/07. a)The partially completed elevator (No. 3P12015) was being used by construction site personnel before the overspeed governor assembly was installed. Due to lack of a governor assembly the emergency brake for the elevator (rail brake) was not operable. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Comply with industry standard ANSI A17.3-2002, "Safety Code for Existing Elevators and Escalators", section 3.5.1 Car Safeties; which states 'The car of every elevator that is suspended by wire ropes shall be provided with a car safety device capable of stopping and sustaining the car with its full rated load from governor tripping speed.' Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
