Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to excessive concentrations of carbon monoxide: On or about 1-18-07 In the basement boiler room of 1773 W 1st St, Brooklyn, NY a) An A.O. Smith Promax Water Boiler, Model # PCG 75276, Item # 9200439022, Ser #COGA17862, that uses natural gas was not vented to the flue to remove its exhaust from the boiler room. On 1-18-07 a Keyspan Utility representative measured the Carbon Monoxide level in this room and determined there was a concentration of 600 ppm of Carbon Monoxide. This boiler room abuts a commercial shoe manufacturer tenant in the basement that has 5 employees. The water heater exhaust could fill the boiler room and enter other surrounding business spaces occupied by employees. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS: to comply with NFPA 54 ANSI Z223.1-2006 National Fuel Gas Code, and install a permanent draft hood and vent pipe from this A.O. Smith water heater to the exhaust flue that leads from this room to the roof. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
