Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an improperly rigged drill rack used in conjunction with a Caterpillar 315C excavator: (a) Location - Doak Drive, Chelmsford, MA: On or about 12/19/2006, employees were exposed to being struck by a drill rack that was improperly attached to the excavator. Among other methods, feasible means of abatement include (1) Utilize lifting bar that is provided with the linkage to lift objects per the Caterpillar Manufacturers Manual. (2) Instruct employees to stay clear while lifting objects adjacent to employees.
