Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with powered industrial truck tipover: Location: Shipyard On or about March 21, 2008, employees were exposed to crushing injuries from forklift tipover while operating the Nissan 6000, Komatsu FG 35, and the Komatsu FG 30L/T-12 forklifts on uneven surfaces without using an operator restraint system. Among other methods, one feasible and acceptable means of abatement would be to: 1.Ensure that all sit-down powered industrial trucks operated by employees at the shipyard are equipped with seatbelts; 2.Include use of seatbelts in powered industrial truck operator training; and 3.Enforce the use of seatbelts by powered industrial truck operators.
