Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed crushing hazards associated with operating a skid steer loader that was carrying a load that exceeded the rated operating capacity of the skid steer: Location: 98 Reservation Street, Milton, MA On or about September 26, 2007, an employee's hand was crushed between the top frame of the operator cab of a Bobcat S185 and a dump truck. The employee was operating a Bobcat S185 skid steer loader equipped with a pallet fork attachment was loaded with a section of a tree trunk weighing approximately 1900 lbs. The rated operating capacity of the Bobcat S185 equipped with the pallet fork attachment was approximately 1200 lbs. Feasible and acceptable abatement methods include, but are not limited to, the following: 1.Train operators of lifting equipment on the rated operating capacity of the equipment and any attachments that may be used; 2.A competent person must determine the weight of the loads that will be lifted and convey this information to equipment operators.
