KRS 338.031(1)(a): The employer did not furnish each of its employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.Employees were exposed to serious injuries in the event of an accident such as a collision or tip over while operating the forklifts at the Facility as a result of the practice of allowing employees to operate the forklifts without requiring the use of the seatbelts provided on the forklifts. One feasible and acceptable abatement method to correct this hazard is to require the operators to fasten the installed seat belts when operating the equipment.
